1.1. Ubber White (Ubber White Lda.) detains products for sale at the site www.ubberwhite.com, where the “e-commerce” services are exclusively available for the final users/”consumers”.
1.2. The “Consumer” refers to the individual that acts/buys out of his/her business or profession. If you are not a “consumer” we request that you do not shop at the online store www.ubberwhite.com.
1.3. Ubber White (Ubber White Lda.) reserves the right to not process received orders by users who are not “consumers” or those who do not comply with the general sales conditions of the Vendor Ubber White (Ubber White Lda.).
1.4. These conditions and general sales terms regulate exclusively the offer, transmission and approval of orders made at www.ubberwhite.com.
1.5. The consumer must provide an e-mail address to the “Vendor” or other identification data which is accurate and complete and accepts that the “Vendor” can contact him/her using this data, in case it is necessary.
2. HOW TO ORDER
2.1. To order at www.ubberwhite.com it’s necessary that the user has an e-mail account and that the browser used is configured to accept cookies and pop-ups, so that all the conditions offered by the online store Ubber White (Ubber White Lda.) can be properly enjoyed.
It’s easy to order at www.ubberwhite.com:
a) Find the product you want to acquire;
b) Add the selected products to the Shopping Bag;
c) Complete the purchase;
e) Select the payment option;
f) Review you order;
g) Proceed to payment and confirm the order;
h) You will receive a confirmation on your e-mail.
Your order is confirmed when you select the button “Confirm Payment” (Checkout) in the end of the purchase process.
When Ubber White (Ubber White Lda.) receives your order, a message with your order number and all its details will appear on your screen.
The purchase agreement is completed at that moment.
A confirmation of the order is sent to your e-mail. We suggest that you print or download it as a future reference.
We reserve the right to not approve your order or cancel it even after the automatic confirmation. When you send the order form, you are accepting the general conditions of the purchase, as well as other existing conditions at www.ubberwhite.com, including the conditions and usage general terms.
The vendor may not process the orders that don’t guarantee a successful charge; when the orders are incomplete or inaccurate, or when the ordered products are no longer available. In the referred cases, we will inform you with an e-mail communicating that the sale contract was not completed and that the vendor did not proceed with the sale, specifying the reasons for that.
If the products presented on the online store (www.ubberwhite.com) are no longer available at the moment of your last access or when the vendor receives the order, the vendor must inform about the availability of the product within 30 days after the reception of the order.
If an order and payment of products that are no longer available has been made, the vendor will reverse the payment of the unavailable items.
2.2. Right to not accept an order or cancel the purchase
Ubber White (Ubber White Lda.) reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even if it has already been approved by us), in the following situations (among others), free from any accountability or any costs:
a) The product is no longer available in stock (the payments will be returned);
b) The invoice information is not correct or controllable;
c) The order is signaled by our Security System as an incorrect order or an order susceptible to fraud;
d) The payment transfer wasn’t received by us in a period of 5 days after the approval of your order;
e) If we think you are under 16;
f) If we think you are a retailer;
g) If there is an error in the price quote;
h) If it’s not possible to deliver the order at the provided address.
2.3. Data Validation
After we receive the order, we can carry out some checking before we prepare it. This checking can include the address credibility and fraud verification. In terms of the fraud verification, we carry out partially automatized verifications in all orders to filter unusual, suspect transactions or transactions identified as susceptible to fraud. The suspects of fraud will be investigated and, if necessary, processed. When you confirm your order, it means you accept these conditions.
3. GUARANTEES AND INDICATION OF THE PRICE OF THE PRODUCT

You can find the available payment methods on the site. We don’t accept any other payment method beyond the mentioned ones. Please, don’t try using any other payment method that is not mentioned. If you do so, we cannot be held responsible for the loss of the payment or any other related damage.
3.2. Payment Process
If you proceed to pay with a Credit Card, we will deduct the proper amount from your account as soon as your order leaves our warehouse. In the case of payment with a Credit Card, all details (for example, card number or expiry date) will be sent by the encrypted protocol to the firm that supplies the remote electronic payment services, without the access of third parties to the transmitted information. This information will not be used by Ubber White except to accomplish the necessary purchase or refund procedures, in case of return, complying with the exercise of the right of return or communication to the police, in cause of fraud. The price of purchase of the products and their shipping price, as indicated on the order form, will be charged to the current account when the acquired products are actually sent.
4. SECURITY OF THE ORDER
4.1. The online store Ubber White (www.ubberwhite.com) uses one of the strongest security technology among the available encryption platforms. Your payment information will be encrypted from the moment you enter until your transaction is processed and they will not be saved in a public server. Although we use encryption software, the security of the information and payments transmitted through the Internet or e-mail cannot be guaranteed. Ubber White (Ubber White Lda.) cannot be held responsible for any damage suffered as a result of the use of communication electronic means, including (although not limited to) defects recurrent damage or delays in the delivery of electronic communications, interceptions or manipulation of electronic communication by third parties or by computer programs used for communication or transmission of virus.
If you choose the ATM Reference, we will start taking care of the order after receiving the payment. This can take several days. In case 5 days have passed after making the order and we haven’t received any payment, the order will be cancelled.
Payments can only be processed if the information used for the invoice can be checked.
5. OWNERSHIP RESERVATION
5.1. Ubber White (Ubber White Lda.) detains the property of the products of the firm until it has received the full payment of all those products.
6.1. The prices of the products displayed on the site contains the Value Added Tax (VAT). The shipping fee is applied by order. 6.2. The prices are all charged in euros. Please, notice that the change of the delivery country can have influence on the prices of the shipping fee.
6.3. The total price
It is possible that the price of the products presented on the site can change. Ubber White (Ubber White Lda.) reserves the right to change the prices without previous notice. The prices displayed at the moment of the purchase are the prices applied to that purchase.

7. QUALITY AND GUARANTEE
Ubber White (Ubber White Lda.) doesn’t sell second-hand products, neither products with defects or inferior quality according to the patterns of the existing market. Each product’s main features displayed at www.ubberwhite.com can be found on the page of each product. The products offered to sell on the online store may not match entirely with the real ones in terms of image and colors, due to the Web browser and monitor used.
All products have an identification label. Don’t remove the label of the acquired product, in case you want to return it.
In case you decide to exercise the right to return the purchased products, Ubber White (Ubber White Lda.) has the right to not accept the return of the products that are returned without their label or those that have been changed regarding their original state, or even if they are damaged.
8. SHIPPING & DELIVERY
8.1. Delivery: where and when
We deliver the products from Monday to Friday, from 9:00 a.m. to 6:00 p.m. We don’t accomplish shipping in certain holidays. We can only guarantee the delivery of an order if the delivery address is an office or a house located in one of the countries mentioned on the list of countries available on the Delivery menu.
To receive the order, it’s necessary to guarantee that someone is at the address. This service does not include a scheduling or booking option, which means the delivery of the order will be accomplished without a previous contact by the shipping firm. We do not ensure this deadline in special periods, like at Christmas or in out-of- stock situations.
A delivery is considered accomplished or a product is considered delivered with the signature of the shipping receipt at the agreed address.
8.2. Delivery Deadlines
In case you confirm your order on a working day until 12:00 p.m. and pay with a Credit Card or through Paypal, your order will be sent on the following working day (weekends and holidays are not considered working days).
In case you choose a payment with ATM reference, the delivery is less effective, since we will only make the delivery after we receive the payment. This can take between 5 to 7 days. The “Vendor” will not be responsible for failure or delay in performance of any commitment if there is a force majeure event, which means an event act or omission out of their reasonable control (Force Majeure Event – constitutes an event act or omission out of the “Vendor’s” reasonable control).
We will try to deliver at the predicted time, as long as it is commercially possible. We normally proceed this way, however we cannot guarantee a timely delivery.
8.3. Partial Deliveries
Whenever possible, we will try to deliver everything in one shipping only. However, we reserve the right to split the delivery of the order, for instance (but not only limited to) if a part of the delivery is delayed or not available. In case we split the order, the customer will be notified by e-mail about our intention. For this purpose, we will use the e-mail provided by the customer at the moment of the purchase.
8.4. Inspection at the moment of delivery
At the moment of delivery, the customer should inspect the package, in order to check for any possible damage. If it is verified that the products are damaged, the customer should not accept the delivery of the order, which will be returned.
Ubber White (Ubber White Lda.) will proceed to the refund of the amount paid for the order and shipping as soon as the warehouse receives and completes the returning process.
Any complaint of non-reception of the order should be accomplished within 30 days from the date the order was placed.
After this deadline, Ubber White (Ubber White Lda.) cannot be held responsible for its loss.
9. SHIPPING FEES
9.1. Shipping fees are applied per order.
The exact price of each shipping depends on the country of delivery. That value will be indicated at the moment of the order.
9.2. Free shipping
If the customer places an order with a price that exceeds the minimum order price defined for their country or campaign, the shipping will be done without any cost, that is to say, for free.
10. RETURNS & CANCELLATIONS
10.1. Cancellation of the order before the shipping
The customer can cancel the order if it hasn’t been shipped yet. If the customer places an order and intends to cancel, he/she should firstly check the order’s status through the menu MY ORDER displayed at the upper right corner of the site’s main page. If the status of the order is “Registered”, it is still possible to cancel it.
However, the customer should contact our Customer Support Service ([email protected]) and ask to cancel the order.
Only after this procedure is it possible to request the cancellation of the order to our warehouse. If the cancellation of the request is well-succeeded, the customer will be notified by e-mail about this decision and the cancellation will be processed without costs for the customer. If the cancellation request is not possible, the products will be sent to the customer who should refuse to accept them, in case he/she wishes to maintain the cancellation of the order. The products will be returned and after receiving them the refunding process will take place. The customized products’ orders (created exclusively for a specific customer) cannot be cancelled, because the customization process will already be underway, since it starts immediately after the reception of the order.
10.2. Cancellation and Return of personalized products
All personalized products, created according to the customer’s particularities – theme and artist – are exclusive and the production/personalization process starts right after the customer’s approval of the project and corresponding payment. Thus, the orders of customized products cannot be, subsequently, cancelled or returned.
The process can only be cancelled if the customer does not approve the created proposal or if it takes more than 5 days to accomplish the payment of the order. In this case, it will be cancelled.
10.3. Return of defective products
The customer has the right to return the delivered products if it is verified that they have defects or other nonconformities regarding the ordered products. The return can be done in a period of 30 days after the reception of the order. This will not affect the statutory rights. In case your complaint is justified, the price and the shipping fees will be refunded. In order to obtain more information about how to proceed with the return and information about the refund, please check the menu Help/FAQ’s of the site.
10.4. Return of the products due to waiver
If by any chance you are not satisfied with the products you ordered, you can return them within 30 days after the reception, as long as:
a) The products have not been washed or used (unless the product mentions the opposite, the customer has the right to try the items to check the size and shape, but he/she cannot use them);
b) The product maintains its original features and the package isn’t damaged (the packages that are carefully opened are not considered damaged);
c) The product is complete (ex. Both items of a pair have to be returned);
You cannot return:
a) Products that have been changed
b) Personalized products.
10.5. Return of gifts
Currently, it’s not possible for someone who has received a product as a gift from someone else to return it. In this case, in order to return the product, you should contact the person who bought it, so that he/she can return it according to the Return Conditions.
10.6. Exchange of Products
To Exchange a product for another one, please, follow the steps in Returns.
10.7. Information about the return
In case your return has as justified reason the existence of a defect or non-conformity with the ordered products, Ubber White (Ubber White Lda.) will endure the shipping and return expenses.
In case the return has been done by other reasons other than the ones that are not the existence of a defect or non-conformity with the ordered products, Ubber White (Ubber White Lda.) will not accomplish the refund of the shipping expenses. However, when returning a product, you are using our shipping supplier. Since the costs incurred by Ubber White (Ubber White Lda.) to carry out the return are the same as the shipping costs, we will not refund the expenses related with the fees that were initially supported by the customer for the corresponding order.
The refunds will be done according to the payment method. If the customer accomplishes the payment by ATM reference, it’s necessary that the customer provides us his/her bank data at the moment the return process starts. This indication is necessary, so that we can refund the money to your account. The customer will receive the refund after the products are developed and processed.

11. CUSTOMER SUPPORT
12. APPLICABLE CONDITIONS TO THE PROMOTIONAL CODES (DISCOUNTS)
12.1. When used according to the established rules, a promotion code will enable the user to enjoy a promotion/discount related to the purchase of a specific product during the period indicated/associate to the promotional code/promotional campaign.
12.2. The promotional codes can only be used in on-line shopping done on the site. The sale, exchange or donation of a promotional code is not allowed. The customer who is a carrier of a promotional code, cannot charge or make it available on any website or any other public offer, donation, sale or exchange. The use of promotional codes for commercial means is not allowed.
12.3. The promotion code is connected to the brand Ubber White. The use of the promotional code connected with another brand, firm or name is not allowed. The use of the promotional code in an illegal, abusive or disrespectful way is also not allowed, as well as any other way that may harm Ubber White’s (Ubber White Lda.) reputation.
12.4. The use of the promotional code is conditioned by only one operation per product and per order. The promotional codes are not combined with any other promotions or special offers.
12.5. The promotional codes cannot be exchanged for money.
12.6. Ubber White (Ubber White Lda.) has no obligation of reediting or returning the promotional codes. However, in case the brand decides to reedit or refund a promotional code, it needs to have access to the initial promotional code. For this purpose, it’s necessary to keep a copy of your promotional code, otherwise it cannot be reedited or replaced in case of loss.
12.7. In cases where Ubber White (Ubber White Lda.) reedits/returns the promotional code, the discount of that value can only be applied in a purchase with the same or higher value as the purchase to which your discount/promotional code was issued.
12.8. Without prejudice to any other rights, Ubber White (Ubber White Lda.) can have/has the right to immediately invalidate the promotional code in case it has reasons to suspect that a promotional code is being used: with violation of the premises mentioned above, misuse or in any other case that Ubber White (Ubber White Lda.) has reasons to proceed that way.
The satisfaction of all orders carried out in the website is subject to the availability. Ubber White (Ubber White Lda.) tries to guarantee that all items placed to sale on the site are on stock. However, Ubber White (Ubber White Lda.) reserves the right to not accept any orders or cancel orders that have already been confirmed for products that are no longer in stock.
In these cases, Ubber White (Ubber White Lda.) will inform the customer if this happens and will proceed to refund the paid amount.
14. EXPIRATION OF THE PROMOTION
The offers of the site are valid only at the moment they are displayed on the site, unless the opposite is communicated. Ubber White (Ubber White Lda.) is not linked to any offer in case mistakes or spelling misunderstandings, prices and other existing information on the site. Ubber White (Ubber White Lda.) reserves the right to cancel any purchase or sale because of these mistakes.
15.1. Ubber White (Ubber White Lda.) will only be responsible for damage suffered by the customer in case these damages result from violations attributed to the contractual obligations of Ubber White (Ubber White Lda.) towards the customer or in case Ubber White’s (Ubber White Lda.) responsibility result in the applicable legal law.
15.2. In case the customer has suffered damage related to the site’s activity, Ubber White’s (Ubber White Lda.) responsibility will be limited to:
a) Damage in the Ubber White products or other material;
b) Reasonable and verifiable costs suffered by the customer to find the cause and the claim’s amount attributed to the damage;
c) The maximum return of the claim mentioned above will be (if applicable) the price of the products in stake
15.3. Ubber White (Ubber White Lda.) cannot be held responsible for the damaged suffered by third parties resulting from the use of any one of our products. Ubber White (Ubber White Lda.) cannot be held responsible for the damage suffered by the customer as a consequence of an improper use of our products.
15.4. Ubber White (Ubber White Lda.) is not responsible for the damage that is a result of inappropriate information on the site.
15.5. In case the customer suffers damage that is a result of serious negligence or malice by Ubber White (Ubber White Lda.) none of the limitations of this article are applicable.
16. APPLICABLE LAW
The present general conditions and all the emergent litigations that are related to these general conditions, including its expiration, the use of the site or any purchase done on this site must be conducted by the Portuguese Law.
17. CHANGING OF THE TERMS & CONDITIONS BY UBBER WHITE
Ubber White (Ubber White Lda.) has the right to change the Terms & Conditions at any time. The customer is subject to the principles and terms in force on the date of the order, unless the law or competent authorities impose any change of them.
